These Terms & Conditions ("Terms") govern your access to and use of Fluentwa (the "Service"), operated by Siddhant V Jha ("we", "us", "our"). By creating an account or continuing to use the Service, you agree to these Terms.
1. The Service
Fluentwa is an AI-powered English speaking coach. You must be of legal age in your jurisdiction to use the Service, and if you use it on behalf of an organisation you confirm you have authority to bind that organisation.
2. Accounts
You are responsible for the accuracy of information you provide, for keeping your credentials confidential, and for all activity under your account.
3. Acceptable Use
You agree not to:
- Use the Service for anything unlawful, fraudulent, or abusive;
- Infringe anyone's intellectual property or privacy rights;
- Interfere with the Service's security or integrity (malware, probing, scraping);
- Reverse engineer, resell, or redistribute the Service; or
- Attempt to bypass technical limits or usage quotas.
4. AI Outputs
Fluentwa uses AI models to provide feedback and generate content. Outputs may be inaccurate or incomplete and are not a substitute for professional advice. You are responsible for your prompts, for verifying outputs before relying on them, and for having rights to any content you submit. We may filter or refuse outputs and restrict accounts that misuse the Service (including for illegal content, hate speech, malware, or jailbreaking attempts).
5. Intellectual Property
We retain all rights in the Service, including software, models, branding, and documentation. You are granted a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You retain rights in content you submit and grant us a limited license to host and process it solely to provide the Service.
6. Payments & Subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, renewals, cancellations and refunds are handled under Paddle's Buyer Terms. See our Refund Policy for how to request a refund.
7. Service Availability
We do not guarantee that the Service will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.
8. Suspension & Termination
We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends and we may delete associated data after a reasonable window.
9. Liability
To the extent permitted by law, our aggregate liability is capped at the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.
10. Governing Law
These Terms are governed by the laws of the jurisdiction in which Siddhant V Jha resides, and disputes will be resolved in the competent courts of that jurisdiction.
11. Changes
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
